What Is Cold Email?

An unsolicited email sent to a prospect with whom the sender has no prior relationship, used for B2B outreach and lead generation.

Cold email is an unsolicited email sent to a potential business prospect with whom the sender has no prior relationship. Unlike spam, cold email targets a specific individual based on a defined ideal customer profile (ICP) and is sent one-to-one (or in small personalised batches), with a specific, relevant reason for reaching out.

Cold email vs. spam

The distinction between cold email and spam is intent and targeting:

  • Cold email: Sent to a specific person based on relevance (their role, company, or industry fits your offer), with a personalised message, an opt-out mechanism, and a specific business purpose.
  • Spam: Sent in bulk to undifferentiated lists with no personalisation, no specific relevance to the recipient, and often without a legitimate opt-out mechanism.

Is cold email legal?

Cold email is legal in most jurisdictions when done correctly. In the United States, it is governed by the CAN-SPAM Act, which requires a valid physical address, an opt-out mechanism, and no deceptive headers. In the European Union, B2B cold email is generally permissible under GDPR's "legitimate interest" basis when the email is relevant to the recipient's professional role and an opt-out is provided. Canada (CASL) and Australia (Spam Act) have their own rules.

Cold email is the primary channel for B2B outbound lead generation because it reaches decision-makers directly at their work email address — where they make purchasing decisions — without requiring paid advertising or prior brand awareness. Effective cold email is short (under 150 words), specific (references something about the recipient's specific situation), and has a low-commitment call to action.
